POLASAÍ NA SCOILE

1. Scoil an tSeachtar Laoch is ainm don scoil

The school will be known as Scoil an tSeachtar Laoch.

 

2. An Ghaeilge a bheidh mar theanga scoile agus múinfear gach ábhar inti

Irish will be the language of the school and all subjects will be taught through Irish.

 

3. Is é polasaí na scoile gach gné den chultúr Ghaelach a chothú agus a spreagadh.

The policy of the school shall be to promote and encourage all aspects of Irish culture.

 

4. Déanfar gach iarracht chun go mbeidh na daltaí ina nEireannaigh.

It will be a function of the school to teach and foster those ideas in the pupils which would be befitting them as Irish people.

 

5. Glacfaidh Cumann na dTuismitheoirí leis na treoirlinte le haghaidh polasaí dearfaigh i gcúrsaí araíonachta agus iompar sa scoil chomh maith le rialacha na scoile seo.

   The national guidelines towards a positive policy for school behaviour and discipline in conjunction with the rules of this school shall be accepted by Cumann na dTuismitheoirí

 

CUMANN NA dTUISMITHEOIRÍ

 

1. Beidh an scoil faoi stiúradh thuismitheoirí na bpáistí a bheidh ag freastal an scoil ar ala na huaire

 The school will be under the control of the parents of the children attending the school

 

2. Cumann na dTuismitheoirí a thabharfar ar na tuismitheoirí mar ghrúpa

The parents as a group shall be known as Cumann na dTuismitheoiri.

 

3. Ni bheidh cead ballraíocht i gCumann na dTuismitheoirí ach ag tuismitheoir nó caomhnóirí páistí atá ag freastal ar an scoil ar ala na huaire.

 Membership of Cumann na dTuismitheoiri shall be open only to parent or guardians of children attending the school.

 

4. Ceapfaidh Cumann na dTuismitheoirí Coiste Ceannais chun an scoil a riaradh.

 Cumann na dTuismitheoiri will appoint a Coiste Ceannais to administer the school

 

5. Is féidir cruinniú speisialta de Chumann na dTuismitheoirí a thionól ach é a bheith fogartha go sainiúil

(a) ar iarratas sínithe ag trian de na baill nó

(b) trí breith tromlaigh ar a gCoiste Ceannais. Ní phléifear ach an gnó speisialta sin ag an gcruinniú.

 A special meeting of Cumann na dTuismitheoiri may be convened for a specifically declared purpose on a requisition signed

   (a) by one third of the

   or (b) by a majority of An Coiste Ceannais.

   Only the special business for which the meeting has been convened shall be dealt with.

 

 

6. Ag gach cruinniú i gcás cothromaíocht votaí beidh an dara vota mar vota réitigh ag an gcathaoirleach. Ní bhaineann an riail seo le toghcháin.

At all meetings in the case of equality of votes the chairperson shall  have a second and casting vote. This rule does not apply to elections.

 

7. (1) Más gá cruinniú speisialta de Chumann na dTuismitheoirí a thionól chun athruithe a dhéeanamh ar an mbunreacht seo, cuirfear Riail a 5 i bhfeidhm.

(2) Má ghlactar leis an tairiscint trí thromlach de dhá thrian, ar a laghad de na tuismitheoiríi a chaith vota, tiocfaidh se i bhfeidhm láithreach agus leasfar an bhunreacht seo dá réir.

(1) Should it become necessary to convene a special meeting of Cumann na dTuismitheoiri for the purpose of constitutional amendment, Rule 5 will be applied.

   (2) If the motion is carried by a majority of at least two-thirds of the parents voting, it shall become immediately effective, and this constitution will be amended accordingly.

 

8. Caithfidh an Cisteoir cuntas cruinn a choimead a thaispeánfaidh cursaí airgeadais, faltais agus caiteachais Chumann na dTuismitheoirí.

   Detailed accounts must be kept by the Treasurer, showing the financial affairs, income and expenditure of Cuman na dTuismitheoiri.

 

 

AN BORD BAINISTÍOCHTA

 

1. Glacfar le Bord Bainistíochta agus is mar seo a bheidh sé curtha le chéile:-

 

• Beirt ar na n-ainmniú ag an Patrún. Glacfaidh an Patrún le beirt tuismitheoir/iarthuismitheoir a ainmneoidh an Bhord Reatha.

 

• Beirt ar tuismitheoirí iad le leanaí cláraithe sa scoil (duine díobh ina máthair, an duine eile ina athair), agus iad tofa ag coiteann na dtuismitheoirí a bhfuil leanaí dá gcuid ar rolla na scoile.

 

(iii) Príomhoide (nó Príomhoide Gníomhach) na scoile.

 

(iv)   Múinteoir amháin eile ar fhoireann na scoile, arna thoghadh le vótáil na foirne teagaisc.

 

(v)   Beirt chomhaltaí breise arna moladh ag na hainnmnithigh sin, mar a thuairiscítear in (i)-(iv) thuas roghnaithe ón ochtar tuismitheoir atá ag ionadaíocht ar son na h-ocht ranganna scoile.

 

 

 A Board of Management shall be adopted and shall be constituted as follows:-

 

• Two direct nominees of the Patron. The Patron will accept the names of two parents/past-parents proposed by the existing Board of Management.

.

   (ii)   Two parents of children enrolled in the school (one being a mother, the other a father), elected by the general body of parents of children enrolled in the school.

 

   (iii)   The Principal Teacher (or Acting Principal Teacher) of the school.

 

   (iv)   One other teacher on the staff of the school, elected by vote of the teaching staff.

 

   (v)     Two extra members proposed by those nominees, described at (i)-(iv) above – to be selected from the eight parents representing the eight classes.

          

2. Má theipeann ar aon bhall den Bord Bainístiochta a thoghaidh Cumann na dTuismitheoirí an téarma oifige a chríochnú ar chúis ar bith déanfaidh an Coiste Ceannais ar a gcéad cruinniú eile comhthoghadh ar an té a fuair a céad líon votaí ab airde eile ag an C.C.B. roimh sin.

 In the event of any member of the Board og Management elected by Cumann na dTuismitheoiri, failing for whatever reason, to complete his or her term of office, an Coiste Ceannais at its next meeting shall co-opt the person who gained the next highest number of votes at the previous A.G.M.

 

3. Caithfidh beirt ar a laghad a bheith i ngach toscaireacht ar nithe tabhachtacha.

 All delegations on important issues must number at least two.

 

4. Tosóidh an bhliain airgeadais ar an gcead lá de Mheánn Fhomhair gach bliain agus críocnoidh ar an lá deiridh de Lúnasa an bhliain dar gcionn.

 

 The financial year will commence on the first day of September and end on the last day of August each year.

 

5. (B.B.) Ag an gcéad cruinniú taréis an Cruinniú Cinn Bliana,toghfaidh an Coiste Ceannais: Cathaoirleach, Cisteoir agus Rúnaí. ‘Siad an t-ochtar atá tofa mar bhaill den mBord Bainistíochta, a bheidh iontofa do na trí postanna seo. Mairfidh an Bord Bainistíochta ar feadh ceithre bliain.

 

At its first meeting following the A.G.M. an Coiste Ceannais shall select from the elected 8 to an Bord Bainistíochta: a Chairperson, Treasurer and Secretary. The board will serve for four years.

 

 

6. Is faoi Bhord Bainistíochta na scoile amháin a fhágfar gach plé a bhainfidh le cursaí múinteoirí agus múinteoireachta chomh maith le h-aon chomhfhreagras a bhainfidh le ceachtar díobh sin.

 All matters relating to teachers and teaching as well as correspondance to do with same shall be dealt with solely by the Board of Management of the school.

 

 

 

AN COISTE CEANNAIS

 

1. Is iad a bheidh ar an gCoiste Ceannais:-

A.(i) An t-ochtar ball den mBord Bainistíochta

 

(ii)Ochtar tuismitheoirí (ionadaí as gach rang, a bheidh tofa ag na tuismitheoirí roimhré)

 

*       Roimh gach cruinniú Cinn Bliana, lorgófar tuismitheoirí a bheadh sásta freastal ar an gCoiste Ceannais ar son an ranga ina bhfuil a bpáiste scoile is sine. Sa chás’s go gcuireann níos mó ná duine amháin iad féin ar fáil, beidh deis ag tuismitheoirí an

rang-ghrúpa sin duine díobh a phiocadh i bhfoirm toghcháin poist.

 

**     Beidh beirt den ochtar tuismitheoirí seo ar an mBord Bainistíochta cheanna.

Mar sin, fágann sé sin grúpa de sheisear.

 

(c) Ionadaí ó aon reiligiúin eile má bhíonn cúis leis

 

An Coiste Ceannais will be composed of:-

1. (i) The eight members of the Board of Management.

 

   (ii)Eight parents (a representative from each class, elected by the parents beforehand)

*       Before every A.G.M. parents will be sought to represent the class of their eldest child on the Coiste Ceannais. In the case of more than one going forward from each class, the body of parents will select one person per class by means of a postal vote.

 

**     Two of these parents will also sit on the Board of Management thus leaving a group of six.

   (c) The nominee of any other religion if warrented.

       (b) and (c) being subject to Rules 24.

 

 

2. Ag gach cruinniú i gcás cothromaíocht votaí beidh an dara vota mar vota réitigh ag an gCathaoirleach. Ní bhaineann an riail seo le toghcháin.

 At all meetings in the case of equality of votes the chairperson shall have a second and casting vote. This rule does not apply to elections.

 

 

3. (C.C.) Ag an gcéad cruinniú taréis an Cruinniú Cinn Bliana, togfaidh an Coiste Ceannais: Cathaoirleach, Cisteoir agus Rúnaí. ‘Siad an t-ochtar atá tofa mar bhaill den mBord Bainistíochta, a bheidh iontofa do na trí postanna seo.

 

4. Tiocfaidh an Coiste Ceannais le chéile ar a laghad uair sa mhi. Is é is córam ann leath de na baill. Caithfidh beirt ar a laghad den mBord Bainistíochta a bheith sa chóram.

 An Coiste Ceannais must meet at least once a month to expedite its business. One half of the members will constitute a quorum. The quorum must include at least two members of the Board of Management.

 

 

5. Má tharlaíonn folúntas ar an gCoiste Ceannais breis agus trí mhí roimh an C.C.B. caithfear é a líonadh trí comhthoghadh a dhéanamh ar an té a fuair an chéad líon votaí ab airde eile an C.C.B. roimh sin.

 Any vacancy arising on the Coiste Ceannais more than three months prior to the A.G.M. must be filled by co-opting the person who gained the next highest number of votes at the previous A.G.M.

 

6. Beidh an chumacht ag an gCoiste Ceannais oifigeach ar bith a scor más é a dtuairim nach bhfuil an duine ag comhlíonadh dhualgas na

hoifige.

   An Coiste Ceannais shall have the power to remove any officer, who in their opinion, is not fulfilling the duties of the office.

 

7. Ma bhíonn aon chomhalta den gCoiste Ceannais as lathair ó thri chruinniú coiste as a chéile, gan chúis réasúnach, is féidir é/í a chur as oifig le vota dhá dtrian dá mbeidh i láthair ag gnáthchruinniú coiste. Tabharfaidh an Coiste Ceannais breith faoi

cad is cúis réasúnach ann.

 Any member of the Coiste Ceannais absent from three consecutive meetings, without reasonable cause, may be removed from office by a vote of two thirds of those members present at a regular committee meeting. An Coiste Ceannais will adjudicate upon what constitutes reasonable cause.

 

8. Caithfidh beirt ar a laghad a bheith i ngach toscaireacht ar nithe tabhachtacha.

 All delegations on important issues must number at least two.

 

 

9. (1) Féadfaidh an Coiste Ceannais fó-choistí a bhunú faoi réir aon choinníollacha a shocróidh an Coiste.

(2) Féadfaidh an Coiste Ceannais aon cheann dá fó-choistí a scor uair ar bith.

(3) Is féidir le gach fó-choiste a chruinnithe féin a shocrú ar coinníollacha nach saraítear an bhunreacht seo.

(4) Tabharfaidh an Coiste Ceannais cead d’aon cheann dá fó-choistí airgead a chruinniú, a bheith aige nó a chaitheamh chun cuspóirí ceadaithe an choiste sin a bhaint amach.

 

 (1) An Coiste Ceannais shall have power to set up sub-committees subject to any conditions which shall be determined by an Coiste.

   (2) An Coiste Ceannais shall have the power to dissolve any of its sub-committees at any time.

   (3) The Coiste Ceannais shall permit any of its sub-committees to hold and expand funds for the approved purpose of that sub-committee.

   (4) Each sub-committee may arrange its own meetings and procedure provided that no part of this constitution is contravened.

 

10. Tosóidh an bhliain airgeadais ar an gcéad lá de Mheánn Fhomhaie gach bliain agus críochnóidh ar an la deiridh de Mí Lúnasa an bhliain da gcionn.

 The financial year will commence on the first day of September and end on the last day of August each year.

 

11. Caithfear na cuntaisí a chur ar fáil chun a n-iniúchta ar a laghad uair amháin in aghaidh na bliana agus aon uair eile a cheapann Coiste Ceannais sin a bheith riachtanach.

 The accounts must be presented for audut annually and at any time deemed necessary by An Coiste Ceannais. Auditors will be appointed annually at the A.G.M.

 

12. Ag an gCoiste Ceannais amháin a bheidh an ceart chun caitheamh agus bailiú airgid a udaru.

 An Coiste Ceannais shall have the sole right to authorise the spending and collection of funds.

 

13. Cuirfidh an cisteoir tuarascáil airgeadais faoi bhráid gach cruinniú den gCoiste Ceannais.

 The treasurer will submit a financial report to each meeting of an Coiste Ceannais.

14. 
    (a) Beidh ar an gCisteoir adhmháil a sholáthair i gcomhair pe airgead a tugtar dó/dí, mar iarrtar a leithéad.

(b) Caithfidh an cisteoir admháil a fháil, gach uair gur féidir, ar son airgead a íocann sé/sí amach.

 (a) The treasurer must, when requested, issue a receipt for all monies lodged with him/her.

   (b) The treasurer must obtain a receipt where possible for all monies disbursed by him/her.

 

 

 

CRUINNIÚ CINN BLIANA

 

1. (a) Beidh Cruinniú Cinn Bliana de Chumann na dTuismitheoirí roimh Nollaig chun tabhairt faoi chlár oibre mar atá leagtha amach in Airteagal 12.

(b) Beidh cead freastal agus vota ag foireann teagaisc na scoile.

(c) Is é córam ann 20% de na baill móide duine amháin.

 

   (a) A general meeting of Cumann na dTuismitheoirí shall be held before Christmas for the purpose of following the agenda laid out in Article 12.

   (b) The teaching staff may attend and vote.

   (c) 20% of the members plus one will constitute a quorum.

  

2. (a) Caithfear fógra 10 lá ar a laghad a thabhairt i scríbhinn do gach teaghlach i dtaobh dáta an Chruinniú Cinn Bliana. Má tharlaíonn tré thimpiste nach bhfaigheann gach teaghlach fógra fós rachaidh an cruinniú ar aghaidh.

(b) Beidh vóta ag gach tuismitheoir agus féadfar é/í a thoghadh don gCoiste Ceannais.

 (a) At least 10 days notice of the A.G.M. must be given in writing to all families. Accidental non-receipt of notice shall not invalidate the meeting.

   (b) Each parent shall have a vote and may be elected to an Coiste

        Ceannais.

 

3. Caithfidh fógraí tairisceana, leasaithe ar an mBunreacht agus ainmniúcháin do na toghcháin an Rúnaí a shroichint i scríbhinn ar a laghad seacht lá roimh an C.C.B.

 Notices of motion, amendments to the constitution and nominations for elections must reach the secretary in writing not later than seven days before the date of the A.G.M.

 

4. Caithfidh na hainmniúcháin agus moltaí a bheith sínithe ag moltóir agus ag cuiditheoir. Ní mór d’iarrthoirí a n-ainmniúcháin a chomhsíniú.

 Nominations and motions must be signed by proposer ans seconder. Nominations must be counter-signed by the candidate.

   The agenda of the A.G.M. shall be as follows:-

1. Moments silence
2. Minutes of previous A.G.M.
3. Correspondence.
4. Secretary’s Report.
5. A few words from the Principal.
6. Financial report and audited accounts.
7. Appointment of scrutineers and elections.
8. Notices of motions.
9. Appointment of auditors.
10. Any other business.

 

6. Ceapfar beirt scrúdanóirí nach iarrthoirí iad, chun na toghchain a stiúradh.

   Two scrutineers who shall not themselves be candidates shall be appointed to supervise the elections.

 

7. Tabharfar amach agus baileofar páipéir votála ag an C.C.B. Is é an córas aon-vota do-aistrithe a bheidh i bhfeidhm don votáil.

 Ballot papers shall be issued at and collected at the A.G.M. Voting shall be on the system of the single non-transferable vote.

 

8. Ní bheidh an uimhir votála ar an bpáipéar ballóide níos mó ná an uimhir fholúntas ar dhata votála.

 The numbers of votes recorded on the ballot papers shall not exceed the number of vacancies at the date of the poll.

 

9. Ag gach cruinniú i gcás cothromaíocht votaí beidh an dara vota mar vota réitigh ag an gCathaoirleach. Ní bhaineann an riail seo le toghcháin.

 At all meetings, in the case of equality of votes, the Chairperson shall have a second and casting vote. This rule does not apply to

   elections.

 

10. Is féidir gnáthrialacha a chur ar fionraí ag aon chruinniú ar choinníoll go nglacann dhá dtrian dá bhfuil de bhaill i láthair le tairiscint chuige sin.

Standing orders at any meeting may be suspended provided a motion to that effect is adopted by two-thirds of the members present.

 

 

11. Caithfidh aon mholadh chun an bhunreacht seo a leasú a bheith i bhfoirm fógra tairisceana agus caithfidh sé na coinníollacha mar atá leagtha síos i Rialacha 3 agus 4 a chomhlíonadh.

 Any proposal to amend this constitution must take the form of a notice of motion and must fulfill those requirements laid down in Rules 3 and 4.

 

 

GINEARÁLTA

 

42. I gcás coimhlint mhínithe idir an leagan Gaeilge agus an leagan Béarla den mBunreacht seo nó d’aon chuid de, beidh tosaíocht ag an leagan Gaeilge ar an leagan Béarla.

 In the event of a conflict of interpretation as between the Irish version and the English version of this constitution or any part  thereof, the Irish version shall have precedence over the English version.
